13. Refund Policies
At Sensible Wellness, we are committed to providing the highest level of professional service to all our clients. To ensure we can offer the best service to you and all our valued clients, we have implemented the following refund policies for our nutrition assessments, programs, and meal plans:
Non-Refundable Rate for Nutrition Assessments
The rate for our nutrition assessment is non-refundable. This policy is in place to protect Sensible Wellness in circumstances of sudden cancellations and to compensate the business for the time, effort, and resources expended up to that point. When you miss an appointment or fail to give sufficient notice of cancellation, it impacts our ability to serve other clients who may have been turned away due to the time allocated specifically for your service. This is to ensure fairness to all clients trying to secure an appointment.
Cancellation Policy for Nutrition Assessments
Cancellations made within 48 hours of the scheduled appointment: A fee of $100 will be charged to cover the preparation of the initial assessment. In such cases, a report of the prepared initial assessment will be sent to you.
We understand that emergencies happen, and we may use our discretion to waive or relax this policy under exceptional circumstances.
Refund Policy for Nutrition Programs and Meal Plans
We invest significant time and resources in preparing personalized nutrition programs and meal plans. To protect our business and ensure fairness to all clients, we have the following refund policy for these services:
– Cancellation Before Program Start: If you cancel your nutrition program or meal plan before it starts, you will receive a refund minus a $50 administrative fee for the work already completed.
– Cancellation After Program Start: Once the nutrition program or meal plan has commenced, no refunds will be issued. This policy is in place because significant time and effort go into creating personalized plans, and once these resources are allocated, they cannot be recovered.
– Exceptional Circumstances: We understand that life can be unpredictable. In the case of emergencies or extenuating circumstances, we may use our discretion to offer partial refunds or credits towards future services.
14. Indemnity
You agree to indemnify and hold Sensible Wellness harmless from any claims, damages, losses, liabilities, and expenses arising out of your use of our services or violation of these Terms.
15. Disclaimer of Warranties
Sensible Wellness does not guarantee any specific results from our services. All recommendations and advice are based on our professional expertise but may not suit every individual.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand, specifically the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Any disputes arising out of these Terms or your use of our services shall be resolved in the courts of New Zealand.
